1. Acceptance of Terms


By accessing www.clarityux.in or using any part of the ClarityUX service—including the Figma plugin, web application, or related tools—you agree to these Terms and Conditions, our Privacy Policy, Refund and Cancellation Policy and any updates related to account access, billing, and authentication. ClarityUX is a product of Ethereon D Lab Pvt. Ltd., a company registered and operating in India.


2. Services Description


ClarityUX provides AI-powered design analysis tools, accessible via web and plugin interfaces. These tools are available via a subscription model, with a 14-day free trial for first-time users. After the trial, localized monthly billing applies. Users may cancel subscriptions anytime via their dashboard. We reserve the right to modify, limit, or discontinue any part of the service at any time. 3. Beta Testing


Beta access is provided strictly “as is,” without warranties of any kind. By participating in any beta program, you agree to:

  • Provide relevant feedback if requested

  • Promptly report bugs or usability issues

  • Maintain confidentiality regarding unreleased features and functionality


4. User Accounts


4.1 Account Registration

To use ClarityUX services, you must create an account either by:

  • Signing up with a valid email address and password, or

  • Using your Google account via secure OAuth authentication

By using Google to register or sign in, you authorize ClarityUX to access your basic profile information (including name, email, and profile image) in accordance with our Privacy Policy.

4.2 Account Accuracy
You agree to provide accurate, complete, and up-to-date information when creating your account. You must not impersonate another person or misrepresent your identity or affiliation with any entity.

4.3 Security and Access
You are solely responsible for:

  • Keeping your login credentials secure (including third-party logins like Google)

  • Ensuring your device and session are protected from unauthorized access

  • All activities that occur under your account, whether or not authorized by you

If you suspect unauthorized access or misuse of your account, you must notify us immediately at contact@clarityux.in.

4.4 Account Ownership and Use
Accounts are intended for individual use. Shared accounts or login sharing across teams or organizations is prohibited unless explicitly authorized under a business or enterprise plan.

4.5 Account Termination or Suspension
We reserve the right to suspend or terminate accounts that:

  • Violate these Terms or our Acceptable Use guidelines

  • Engage in misuse, abuse, or fraudulent activity

  • Attempt to bypass subscription or access controls

Access may also be restricted temporarily during system updates or legal compliance actions.

5. User Content and Data Processing


When you upload design files or content to ClarityUX:

  • You retain ownership of all content you submit.

  • We do not store, access, or retain your content beyond what is required for real-time or near-term analysis by AI engines such as Groq and Gemini. However, certain analysis outputs and associated data may be stored securely on third-party infrastructure such as Cloudinary for performance, retrieval, and feature continuity purposes (e.g., dashboard history, mobile access).

  • By using ClarityUX, you consent to the storage of analysis-related content on Cloudinary, in accordance with their data processing and security policies. We ensure this data is stored with appropriate safeguards and is not shared with Cloudinary for advertising or profiling.

  • You confirm you have the legal right to upload and process such content.

  • You acknowledge that AI-powered analysis may not be 100% accurate or error-free, and results should be used as guidance rather than absolute conclusions.

  • Limited tracking and analytics data may be collected as described in our Privacy Policy. We do not share your content or personal data with third parties for marketing or unrelated purposes.


6. Intellectual Property


All intellectual property rights related to ClarityUX—including software code, algorithms, UI/UX, visual design, and branding—are the exclusive property of Ethereon D Lab Pvt. Ltd.
You may not:

  • Copy, reverse-engineer, modify, or distribute any part of the service

  • Create derivative works based on our services

  • Use our trademarks or branding without written permission


6A. User Content, Intellectual Property, and Community Representation


User Content and Intellectual Property Rights

  • You confirm and warrant that you have all necessary rights, licenses, and permissions to upload, submit, and process any content, including logos, trademarks, or other intellectual property, through ClarityUX.

  • You are solely responsible for ensuring that your use of any third-party intellectual property (such as company logos or trademarks) complies with applicable laws and rights of the respective owners.

  • Ethereon D Lab Pvt. Ltd. assumes no responsibility or liability for any claims arising from your unauthorized use of third-party content.


User Identification and Safety


  • Ethereon D Lab Pvt. Ltd. reserves the right to identify and verify users of the ClarityUX service for safety, security, and community trust purposes. This may include linking user accounts to organizations or brands they represent based on the information you provide or content you upload.


Showcasing User Feedback and Brand Representation


  • To support and grow the ClarityUX community, Ethereon D Lab Pvt. Ltd. may showcase user feedback, reviews, comments, and publicly available information about the brands or companies you represent on marketing materials, case studies, the website, or other public communications.

  • This representation is solely intended to foster community support, transparency, and shared learning among users.


Right to Remove

  • If you object to the use or representation of any such feedback, brand association, or content, you may submit a written removal request to us at contact@clarityux.in. Upon verification, we will promptly take down or discontinue such representation.

  • This policy ensures a respectful balance between community sharing and individual rights.


7. Payment, Subscriptions, Cancellations & Refunds


7.1 Subscription Billing
ClarityUX operates on a recurring subscription basis after a 14-day free trial. Charges are billed monthly in the local currency equivalent to USD $4.99 (see pricing by region on our website or subscription screen). Payment processing is securely handled by our global payment partner, Paddle and Razorpay.


7.2 Free Trial
New users receive 14 days of free access. You may cancel at any time during this period to avoid billing. If not cancelled, your subscription will begin automatically at the end of the trial.


7.3 Cancellation
You may cancel your subscription at any time from your ClarityUX dashboard. Cancellation is effective at the end of the current billing cycle. No refunds will be issued for unused days after cancellation.


7.4 Refund Policy
All payments are considered final and non-refundable. However, ClarityUX may, at its sole discretion, review and approve refund requests in rare, verifiable cases such as:

  • Duplicate charges

  • Technical errors on our side that prevent service access

  • Unauthorized transactions (subject to review)

7.5 Localized Pricing and Tax
Pricing may vary by region and currency. Taxes such as VAT or GST may be applied as required by local laws. ClarityUX and Paddle/Razorpay ensure compliance with global digital service tax regulations.


8. Limitation of Liability


To the fullest extent permitted by law, Ethereon D Lab Pvt. Ltd. shall not be liable for:

  • Any indirect, incidental, or consequential damages

  • Loss of data, design assets, or business opportunities

  • Any disruption caused by third-party services (e.g., Figma, Cloudinary, browser issues)

  • The accuracy, completeness, or usefulness of any AI-generated design analysis or recommendations

  • Unauthorized access, data breaches, or security incidents beyond our control
    Our total liability, if any, shall be strictly limited to the amount you paid for the specific service in question.


9. Indemnification

You agree to indemnify, defend, and hold harmless Ethereon D Lab Pvt. Ltd. and its affiliates from and against any claims, losses, damages, or expenses (including legal fees) arising from:

  • Your misuse of the service

  • Your breach of these Terms

  • Any content submitted or uploaded by you


10. Governing Law


These Terms are governed by the laws of India. Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Bangalore, Karnataka, India.


11. Changes to Terms


We may update these Terms from time to time. Continued use of ClarityUX after any modifications constitutes your binding acceptance of the revised Terms. It is your responsibility to review these Terms periodically.


Note: This document reflects our transition to a subscription-based model as of June 29, 2025. For legacy pay-as-you-go users, billing terms may differ until fully migrated.


12. Legacy Users & Transition to Subscription Model

12.1 Transition Period
Users who signed up before June 29, 2025 (“Legacy Users”) may retain access to pay-as-you-go features under previous pricing terms until formally migrated to the subscription model.

12.2 Grandfathered Access
During the transition, legacy users may continue:

  • Accessing previously purchased features or credits

  • Using the Figma plugin or web tools without a subscription, if they previously paid for them

This access will continue until:

  • The user opts into the subscription plan, or

  • ClarityUX provides 15 days’ notice of deprecation or migration

12.3 Migration Notice
We reserve the right to migrate all legacy accounts to the subscription system. Users will be notified via email and/or in-app alerts. Continued use post-migration implies acceptance of the updated payment model.

12.4 No Retroactive Refunds
Legacy users are not entitled to refunds for previous one-time purchases, unused credits, or changes to product structure. Access to past purchases remains unaffected for the announced period.
